General terms and conditions

The BV Fairplace has its registered office and address at Paanderstraat 76 in 8791 Waregem (province of West Flanders, Belgium).

The Fairplace offices + warehouse are located in K-orner, Rijselsestraat 23, 8500 Kortrijk (part of the HangarK business center).

The following general terms and conditions apply to the sale of toys and game materials via the webshop:

Application ing

Each order via the websites www.fairplace.be and www.fairplace.nl leads to a sales agreement between Fairplace bvba (hereinafter referred to as 'seller') and a client (hereinafter referred to as the 'buyer').

Order and payment

An order is legally valid as soon as the buyer receives an order confirmation. Anyone who places an order with the seller is deemed to be of legal age and agrees to the terms of delivery and payment.

All our prices are stated in euros and include 21% VAT. Shipping costs are charged extra but are clearly indicated at the time the buyer completes and pays for his order. The seller reserves the right to change or correct the prices and product information shown at any time.

Fairplace works together with partner Multisafepay for a secure payment environment. This payment platform is integrated into the webshop. Payment can be made via credit card (Visa or Mastercard), via Bancontact/Mister Cash, via Maestro, via PayPal or iDEAL (Netherlands).

Delivery

Products are currently delivered in Belgium, the Netherlands and France. The seller tries to deliver the ordered products as soon as possible, and gives an indicative delivery time to the buyer. We emphasize that this indication is only indicative, and that the seller cannot be held responsible for delays that are beyond his control. The buyer is also responsible for correctly entering the delivery address.

The seller's deliveries are made via different partners. We mainly send with Bpost , sometimes with PostNL and regularly with our own carrier M-Express (for larger shipments on pallet). Fairplace cannot be held liable for delays incurred during shipping. In accordance with the Law of 21/12/2013, the maximum delivery time is thirty days, unless otherwise agreed. If this delivery period is not feasible, the seller must notify the buyer of this in good time and the buyer has the right to cancel the order, without additional costs. Any amounts already paid will in that case be refunded within thirty days.

Retention of title

The ordered goods remain the property of Fairplace BV until the full price, including VAT, shipping and other possible costs have been paid. In case of non-payment, we reserve the right to take back the goods, by operation of law and at the expense of the buyer.

Right of withdrawal and returns

The buyer must inform the seller of this in writing (by email hallo@fairplace.be or via the contact form on the website) and send the refused products back to the seller, at the buyer's expense. The buyer returns the products in a sturdy cardboard box, in undamaged and unused condition , together with proof of purchase. In no case will unreported or insufficiently stamped returns be credited.

Items that are returned to us under the conditions as described above, will be refunded by us within a period of ten working days. Shipping costs, made by us or by you, will not be refunded, so you will receive the purchase price minus the amount of the shipping costs. However, if it concerns an item that was incorrectly delivered by bvba Fairplace, we will cover the costs for shipping.

Warranty

All our articles are covered by the statutory warranty period for hidden defects and the guarantee in case of consumer purchase. We are responsible for any damage resulting from intentional and gross negligence but cannot be held liable for general or special indirect damage, of whatever nature, suffered by the buyer.

Complaints

We check all our items before sending them and ensure proper packaging. The buyer agrees to check the order upon delivery. Never accept packaging that is damaged during transport and check your shipment immediately upon receipt. If you nevertheless notice damage to the items you ordered, we ask you to inform us immediately, if possible we ask you to email us a photo of the damaged item. Never throw away the postal packaging before you have determined that your shipment is in good condition.

Privacy

Ordering from www.fairplace.be inevitably requires that you provide us with your customer data . We use this data to process your order, deliver it and follow up on the payment. Only if the buyer gives permission for this, the data can be used for advertising purposes, but only directed to the address details of the buyer.

This data will not be passed on, rented or sold to third parties. The buyer always has the right to inspect and improve this data, regulated by the Privacy Act. Upon request (with a simple email to hallo@fairplace.be) we will remove your data from our database. If you have any questions about our privacy statement, you can always contact us.

It is absolutely our intention to increase confidence in buying toys online, not to break it.

Electronic evidence and severability

All parties accept electronic evidence (such as e-mail, for example) within the framework of their mutual relations.

If any article of these terms and conditions is declared null and void, such nullity shall not affect the validity of the remaining articles.

Applicable law

All agreements between Fairplace BV and the client are subject to Belgian law . The Belgian courts have exclusive jurisdiction.
